1. Acceptance of Terms

By accessing or using the Cheers platform ("Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service. Cheers is operated by Cheers Kenya ("we", "us", "our").

2. Eligibility

You must be at least 18 years of age (legal drinking age in Kenya) to use Cheers. By creating an account or using the Service, you represent and warrant that you are of legal drinking age.

3. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorised use of your account.

4. User Conduct

You agree not to:

  • Post false, misleading, or defamatory content.
  • Use the platform for any illegal purpose.
  • Harass, abuse, or threaten other users.
  • Impersonate any person or entity.
  • Upload content that infringes on intellectual property rights.
  • Attempt to gain unauthorised access to any part of the Service.

5. Venue Listings

  • Venue Representatives must have authorisation to list a venue on the platform.
  • Venue information must be accurate and kept up to date.
  • We reserve the right to remove or suspend any venue listing that violates these terms.
  • Listing packages (Karibu and Premium) are subject to their respective terms and pricing.

6. Payments & Transactions

  • Payments are processed via Paystack and M-Pesa.
  • A platform fee applies to ticket sales, gifts, and service bookings.
  • Withdrawal of earnings is subject to applicable transfer fees.
  • All prices are in Kenya Shillings (KES) unless otherwise stated.
  • Refund policies apply as outlined for each transaction type (tickets, gifts, bookings).

7. Event Tickets

  • Ticket purchases are subject to availability.
  • Cancellation and refund policies are set by the event organiser.
  • Cheers is not responsible for event cancellations or changes made by venue owners.

8. Content & Intellectual Property

  • You retain ownership of content you post on Cheers.
  • By posting, you grant Cheers a non-exclusive licence to use, display, and distribute your content on the platform.
  • The Cheers name, logo, and brand elements are our intellectual property.

9. Limitation of Liability

Cheers is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. We do not guarantee the accuracy of venue information, event details, or user-generated content.

10. Responsible Drinking

Cheers promotes responsible drinking. We encourage users to drink responsibly and make safe choices. We are not responsible for any consequences arising from alcohol consumption associated with use of the platform.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms. You may delete your account at any time by contacting us.

12. Changes to Terms

We may update these Terms & Conditions from time to time. We will notify users of significant changes. Continued use of the Service after changes constitutes acceptance of the updated terms.
